Terms of use of digitalaxy.eu
version 1.2 · in force from 6 August 2026 · translation of the binding Polish text
§1. General provisions
1. The digitalaxy.eu website (the „Website") is operated by DIGITALAXY Robert Palczewski, tax ID (NIP): 7392933373, e-mail: biuro@digitalaxy.eu (the „Service Provider").
2. These Terms set out the rules for using the Website, including the contact form and the conversational assistant (the „Chat").
3. Use of the Website is free of charge and does not require registration.
§2. Scope of services
1. The Website is informational in nature — it presents the scope of the Service Provider's activity.
2. The Website provides: (a) a contact form, (b) the Chat, allowing questions about the Service Provider's activity and a preliminary description of a need („enquiry analysis"), (c) optional forwarding of a Chat conversation to the Service Provider — solely at the user's explicit request.
§3. The Chat — reservations
1. The Chat is an automated assistant based on a language model. Despite all due care, its answers may be incomplete or untrue and are informational only.
2. The Chat is not authorised to make or accept offers, provide quotations, conclude contracts or incur any obligations on behalf of the Service Provider. Binding arrangements require direct contact with the Service Provider.
3. Answers given by the Chat do not constitute legal, tax or technical advice.
4. Users should not enter sensitive data into the Chat (e.g. health data, financial data, passwords) or personal data of third parties.
5. Using the Chat contrary to its purpose is prohibited, including: attempts to circumvent its instructions or safeguards, generating unlawful content, actions disrupting the operation of the Website and automated querying. The Service Provider may restrict or block access to the Chat in the event of abuse.
6. Where actions described in point 5 are detected or reasonably suspected, the Service Provider may preserve the content of the conversation together with related technical data (including the IP address, browser data, session identifier and timestamps) — for the purpose of analysing the event, taking remedial measures and establishing, exercising or defending legal claims, including disclosure to competent authorities. The scope and retention period of such data are described in the Privacy Policy.
7. Questions the Chat was unable to answer are recorded for 72 hours solely in order to extend its knowledge base — without the IP address and without any data allowing the question to be linked to a user. Details are described in the Privacy Policy.
§4. Liability
1. The Service Provider makes every effort to keep the Website working correctly but does not guarantee uninterrupted availability.
2. To the extent permitted by law, the Service Provider is not liable for decisions taken on the basis of the informational content of the Website, including answers given by the Chat.
§5. Intellectual property
The content of the Website, including the logo and the graphic layout, is legally protected and may not be used without the Service Provider's consent, except within the limits of permitted use.
§6. Complaints and contact
Remarks concerning the operation of the Website may be sent to biuro@digitalaxy.eu. A reply will be given within 14 days.
§7. Final provisions
1. The Service Provider may amend these Terms; a new version takes effect upon publication on the Website.
2. Matters not governed by these Terms are subject to Polish law.
3. The rules for processing personal data are described in the Privacy Policy.

1. Data controller
The controller of personal data is DIGITALAXY Robert Palczewski, tax ID (NIP): 7392933373, e-mail: biuro@digitalaxy.eu.
2. What data we process and why
a) Contact form — first name, e-mail address, message content. Purpose: replying to the message and, where applicable, preparing an offer. Legal basis: Article 6(1)(b) GDPR (steps taken prior to entering into a contract) and Article 6(1)(f) GDPR (legitimate interest — handling correspondence).
b) Chat — the content of a conversation is processed solely in order to generate a reply. A conversation is not stored after it ends, unless the user themselves requests that it be forwarded to the controller — in which case we process the conversation content and the e-mail address provided in order to reply (Article 6(1)(a) GDPR — consent). To protect against abuse on an ongoing basis we store only counters, rejection categories and technical digests — never the content of conversations. Separately, and for a distinct purpose — extending the assistant's knowledge base — we store for 72 hours the text of questions the assistant was unable to answer. We store the question alone: no IP address, no conversation identifier, no timestamp precise enough to link an entry to a particular visit, and no other data connecting the question to a person. We do not shorten or alter the text of the question, so as not to distort its meaning — which is all the more reason not to enter sensitive data or third-party data into the Chat. Entries expire on their own after 72 hours, and this register is not used to detect abuse or analyse incidents. Legal basis: Article 6(1)(f) GDPR (legitimate interest — developing and improving the quality of the service). As an exception, where abuse is detected or reasonably suspected (in particular attempts to circumvent the Chat's safeguards or use contrary to the Terms), we may preserve the content of the conversation together with technical data — the IP address, browser data (browser and system identification, language, technical request headers), the session identifier, timestamps and technical metadata of the event — until the event has been analysed and remedial measures taken; the scope of the data preserved depends on the severity of the event. Legal basis: Article 6(1)(f) GDPR (legitimate interest — ensuring the security of the service and establishing, exercising or defending legal claims). Please do not enter sensitive data or third-party data into the Chat.
c) Visit statistics — Google Analytics 4 (cookies, online identifiers, approximate location, device data). Purpose: statistics on the use of the Website. Legal basis: Article 6(1)(a) GDPR — consent given in the cookie banner. The Website carries out no advertising or remarketing and does not sell data.
3. Data recipients
a) hosting: OVH — server located in the European Union (Warsaw);
b) provider of the Chat language model: Mistral AI — processing within the EU only, under a data processing agreement;
c) Google Ireland Ltd. (Google Analytics) — only after consent has been given; within this service data may be transferred to the USA on the basis of an adequacy decision (EU-U.S. Data Privacy Framework);
d) apart from the above, data is not transferred outside the European Economic Area.
4. Retention period
Correspondence from the form and forwarded Chat conversations — until the matter is closed, and no longer than 24 months. Statistical data — in accordance with the GA4 retention settings (14 months). Chat conversations not forwarded to the controller are not stored. Questions held in the assistant's knowledge-gap register — 72 hours from being recorded, after which they expire automatically. Data preserved in connection with suspected abuse of the Chat — until the analysis is complete, and no longer than 12 months from preservation; if the analysis does not confirm abuse, the data is erased without delay, no later than within 30 days; where legal claims are being established, exercised or defended, or the matter has been referred to competent authorities — until the matter is finally closed.
5. Your rights
You have the right to: access your data, rectify it, erase it, restrict its processing, data portability, object, and withdraw consent at any time (without affecting the lawfulness of processing carried out beforehand). Requests: biuro@digitalaxy.eu. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (uodo.gov.pl).
6. Cookies and local storage
The Website uses: (a) necessary local storage and cookies — theme selection (localStorage) and language selection (the necessary dx-lang cookie); they contain no personal data and track nothing, (b) Google Analytics statistical cookies — only after consent given in the banner. Consent may be withdrawn or changed in the cookie settings available in the footer.
7. Automated decision-making
The Chat generates answers automatically but does not take decisions producing legal effects concerning users. The Website does not carry out profiling for marketing purposes.
8. Changes to the policy
This policy may be updated (e.g. when a service provider changes). The current version is always available on the Website.
